EVIDENCES IN UKRAINIAN TRIAL


Evidence is defined as the factual data, which give the court grounds for defining the existence or absence of circumstances, which substantiates the claims and objections of the parties or otherwise related to the case. Namely, the court can accept the following types of evidences:

- statements from witnesses and the parties;

- written evidences (i.e. documents, acts, inquiries, correspondence or extract thereof, which relate to the issues of the case);

- material evidences, which provide information related to the issues of the case;

- opinions of experts and specialists.

Parties may submit their statements in oral or written form. Material evidences may include sound and video recording and other types of audiovisual information. Copies of written documents must be submitted, but the originals must be available for examination by the court. We do not advice to submit the original documents in to the case, but submit duly certified copies of the same, as far as the original documents can be occasionally or intentionally lost in the court.
