The competent court to settle the dispute is to be chosen considering two criteria: the jurisdiction and the competence.

The territorial jurisdiction of the courts varies according to the type of judicial proceeding. In general, the claim is to be brought before the court of the defendant's place of residence. However, in many cases the law prescribes other criteria or enables the plaintiff to choose from several options.

There are six types of judicial procedures in Ukraine and in order to file the claim the plaintiff has to choose the right court of appropriate territorial jurisdiction and competence (and accordingly the type of judicial procedure as well) as follows: the civil, the criminal, the administrative, the commercial, the constitutional and the administrative violations procedures. Each of these procedures has its own terms and rules.
