PARTIES AND PARTICIPANTS OF JUDICIAL PROCEEDINGS IN UKRAINE


The list of participants depends on the type of judicial procedure.

The key participants of the criminal litigation are:

- the procurator;
- the victim;
- the accused person;
- the civil plaintiff.

The key participants of the civil and commercial litigation are:

- the plaintiff;
- the defendant;
- the third parties with or without own claims for the object of dispute (interveners)
- the witness;
- the expert;
- the specialist.

The plaintiff(s), defendant(s) and intervener(s) are together referred to as "the parties" enjoying the equal procedural rights and are mainly entitled:

- to examine the case file, to record extracts from the case file and to make copies of the same if required;
- to participate in the court hearings personally or through a representative;
- to present evidence and participate in examination of the same;
- to bring motions before the court;
- to provide opinions concerning various issues within the judicial hearing;
- to object motions and opinions of the other participants;
- to appeal the court decision and/or opinion;
- to appeal the court decision and/or opinion in the cassational procedure.

The parties as well may settle the dispute at any time before the judicial decision is made (except in criminal and constitutional cases or those involving administrative violations, however the prosecutor has the right to withdraw the claim). The plaintiff may change the grounds, the scope or value of the claim, or withdraw it as well. The defendant may accept the claim. Parties are required to respect the court and to use their rights in the good faith.
