PRINCIPLES OF JUDICIAL PROCEDURES IN UKRAINE


The main principles of Ukrainian judicial procedures are established by the Constitution of Ukraine, namely by clause 129 of the same, and subsequently repeated in appropriate procedural Codes of Ukraine as follows:

- the legality;
- the equality of all the participants before the law and the court;
- the guilt is to be proved;
- the adversarial procedure and the freedom to present and prove evidence before the court;
- prosecution on behalf of the State in the court is to be supported by the procurator;
- the right of the accused for a defence;
- the publicity of court procedure and full registration of the same using the technical means;
- the right of appeal and cassational appeal;
- the court decision has the executive force.
